
The Senate recently passed the Marketplace Fairness Act, which gives states the power to require retailers to collect state and local sales taxes for the first time. The line of thought by most major brick-and-mortar retailers is that online retailers have had a pricing edge over traditional stores because online retailers haven’t been required to collect sales taxes. The Marketplace Fairness Act is seen by many Main Street stores as leveling the playing field, with the money from sales tax being sent back to the state where the online shopper lives. (Legally, shoppers are supposed to pay taxes on their online and mail-order purchases, but those “use tax” laws are not enforced, and few shoppers actually file to pay those taxes.)
